
- Article 1 (Terms of Use)
1) By using Specified Nonprofit Organization International Nishikigoi Promotion Center (hereinafter referred to as "INPC") services, you are entering into a contract with INPC per this agreement. INPC reserves the right to change this agreement at any time without notice to users. The updated version of this agreement should be checked upon use.
- Article 2 (Users)
1) Those who need ID registration to receive services of INPC will be defined as users and will be categorized into Individual Users, who apply individually, and Family Users, who apply as a family.
2) You must fill in a new user registration form with true and accurate personal data and should send it to INPC. For the application data to be timely and accurate, we will ask you to revise it accordingly.
3) We will distribute an ID number and password to users who pay the predetermined annual user dues. We do not permit the transfer, loan, or sharing of this ID and password with other people.
4) User services are available through December 31 of the year users start using the services. We will charge an annual user dues per menses, including the month of registration until the end of December of that year, for the first registered year. We will not return annual user dues to those users who cancel their user dues before expiration of user services.
5) Payment should be made by credit card only. We do not accept registered mail, checks, or bank transfers.
6) Annual user dues for individual users is $60 and $48 for family users. In addition, when members (individuals or family) of KOI CLUB (attached list, updated as needed) which have cooperative relationships with INPC become INPC users, individual users will pay $48, and family users will pay $36 per head. However, if only one member of the family members of KOI CLUB, which have cooperative relationships with INPC, register, that member will be treated as an individual user.
- Article 3 (Principle of Self-responsibility)
1) Users will use INPC services at their own discretion and responsibility.
2) Users are responsible for all personal and other information they provide upon user registration and modification.
3) Users may continue, modify, or delete their registration on the users' page.
4) Users are solely responsible for resolving and paying for any inquiries, claims, or problems owning to their use and actions resultant to such use.
5) If users cause damages to INPC or third parties by using INPC's services and by actions resultant of the use of the services (including when users cause damages to INPC and third parties by not obliging to this agreement), users are solely responsible for compensating INPC and third parties for such damages.
- Article 4 (Prohibited Items)
Users are prohibited to do the following in INPC websites and when participating in events as INPC users.
1) Intentional registration of false information.
2) Violation of rights of others, including but not limited to, copyrights, trademarks, rights of privacy, rights of names, portrait rights, defamation
3) Mental abuse of individuals and groups
4) Violation of laws, public orders and morals, and acts that might violate them
5) Provision of information through INPC website for commercial use.
6) Interference with INPC website's operations, or cause of damage to the credibility of INPC
7) Infringement of laws, both by intention or by negligence.
8) Collection and storage of other users' information, or intention to perform such activities
9) Other notifications and advisories INPC gives
- Article 5 (Protection of copyright)
1) Unless accepted otherwise by INPC, users may use any data, texts, oral statements, software, images, and audio (hereinafter called “data”)proprietary to INPC or other copyright holders obtained from the use of INPC, only for personal purposes authorized by the copyright law. Users may not use the data for reproduction, sales, publication, broadcasting, and public transmission outside limits of personal use.
2) Users may not decompile or disassemble data (computer programs). For data with technical protection methods to protect copyrights, no fees shall be charged.
3) Users shall prohibit third parties to violate this article.
- Article 6 (Expulsion)
When users are conisdered to have violated this agreement, it is within INPC’s sole discretion to suspend part or all of such users’ services or to expel them from INPC without any prior notification.
- Article 7 (Responsibilities of INPC)
Users shall take full responsibility with regard to the use of INPC website. INPC is not liable for any damages caused by the use of INPC website’s user registration and services, and other sites and services by third parties accessible through INPC websites
- Article 8 (Viruses)
INPC is not liable for virus damages not protected by normal antivirus methods. Eliminations and modifications caused by viruses and other acts of force majeure are not guaranteed. Users are fully responsible in saving their data.
- Article 9 (Personal Information)
Please see Privacy Policy for details of users’ personal information.
- Article 10 (Information Provided by Users)
Users shall provide their opinions and information in responding to INPC’s surveys at their own discretion and responsibility. INPC has the right to edit and release the survey results without the users’ prior consent. Copyrights of the released survey results all belong to INPC.
- Article 11 (Modification of User Services)
1) INPC may modify or suspend user services without prior notification to users.
2) INPC has the right to discontinue part or all of user services for a long term or terminate them with a one month notice to users.
- Article 12 (Governing Laws and Jurisdictions)
User services and this agreement are governed by the Japanese Law. As to any and all disputes occurring in relation to the user services and this agreement, Tokyo District Court shall be the first exclusive court of jurisdiction.
This agreement is effective as of August 20, 2005.
